The central fact is that D8 and D10 are legal on a federal level in the United States unless your local government has made specific laws to prohibit these cannabinoids. D9 THC is still prohibited on a national level, though it’s been legalized or decriminalized in certain areas.

When it comes to legal cannabis products, there’s an additional complication to consider. Some of these products combine Delta 8 THC and Delta 10 THC. However, as long as the plant used to make these products contains less than 0.3% Delta 9 THC, they’re considered legal throughout the United States. This means that many cannabis products legally available in the country may contain a mix of Delta 8 THC and Delta 10 THC as long as they follow the legal limit on Delta 9 THC.
